Majority Zambians Not Represented In Courts Of Law - OSF

Zambia Open Society foundation has observed with awe at the lack of representation of average Zambians in the court process especially in subordinate and lower courts. 

In a statement made available to WM Media Pty. Ltd, Zambia Open Society foundation Executive Director, Obbious Chikombola said this has derailed many people of fair trial and justice through exaltation of all court procedures and process. 

Mr Chikombola said it is said in the preamble to the United Nations Declaration of human rights Charter that “Whereas recognition of the inherent dignity and of the equal and inalienable rights of all members of the human family is the foundation of freedom, justice and peace in the world. Whereas disregard and contempt for human rights have resulted in barbarous acts which have outraged the conscience of mankind, and the advent of a world in which human beings shall enjoy freedom of speech and belief and freedom from fear and want has been proclaimed as the highest aspiration of the common people. Whereas it is essential, if man is not to be compelled to have recourse, as a last resort, to rebellion against tyranny and oppression, that human rights should be protected by the rule of law.” 


He added, “Article 11 of the united Nations fundamental declaration of human rights states that ” Everyone charged with a penal offense has the right to be presumed innocent until proved guilty according to law in a public trial at which he has had all the guarantees necessary for his defense.” 

He said, “It is in this light that as Open Society Foundation, we call on Government to effectively and efficiently improve man power and Invest in Legal Aid so as to improve free legal representation to our people because its common and public Knowledge that the Sakwiba Sikota of this world, the Lubinda Linyama of this world and the Sangwa’s of this world cannot be easily accessed by an average Zambian. It is undeniable that access to justice has been and has become a luxury in our Country condemning many to losing properties, jailed without the recourse to the law and whilst others imprisoned without fair trial.” 

Mr Chikombola said in order to realize that land of work and joy where all men are strong and free, the Zambian Government and indeed the legal Aid must make Legal Access Available to a common man and the neighbour next door. 

“This will enhance fundamental freedom and human rights which are too often denied to the people.” he said.
